Terms of Service

These terms govern your use of PubSet ("the Service"), operated by Techset Computers, registered in Ireland. By signing up or by using the Service, you agree to these terms. If you don't, please don't use it.

1. The service

PubSet is a software-as-a-service application for hospitality operators. We provide rostering, stocktake, cash book, deliveries, attendance and related tools, made available over the internet on a subscription basis.

2. Your account

  • You're responsible for keeping your login credentials confidential.
  • You must be at least 18 to create an account.
  • You may not share an account between people. Add your colleagues as users — that's what the user management is for.
  • You're responsible for what your invited users do under your tenant.

3. Acceptable use

You agree not to:

  • Use the Service for anything illegal or to harm others.
  • Attempt to access another tenant's data, reverse engineer the Service, or probe it for vulnerabilities outside a coordinated disclosure.
  • Use the Service to send spam or unsolicited communications.
  • Upload content you don't have the right to upload.

Suspected abuse may lead to suspension while we investigate. Confirmed abuse may lead to termination.

4. Subscription, fees, billing

Pricing is agreed when your tenant is set up. Fees are billed in advance on a monthly or annual basis (whichever is agreed). Late payment may lead to suspension. We give you at least 30 days' notice of any price change.

Trial access, where offered, becomes paid at the end of the trial unless cancelled.

5. Your data

You own the operational data you put into PubSet. We hold it on your behalf to deliver the Service. We process personal data in accordance with our Privacy Policy and the GDPR.

You can export your data at any time via the in-app CSV exports. On termination, we keep your data for 30 days then delete on request.

6. Availability

We aim for high availability but do not guarantee a specific SLA on the standard plan. Planned maintenance is communicated in advance where practical. Unplanned outages we work to resolve as quickly as we can.

7. Warranties & liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude implied warranties of merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising out of these terms is capped at the fees you paid us in the 12 months immediately preceding the event giving rise to the claim.

Nothing in these terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

8. Termination

Either of us may terminate the Service on 30 days' written notice. We may terminate immediately for material breach (e.g. non-payment, abuse). On termination you stop owing fees from the next billing cycle, and we delete your data per the Privacy Policy.

9. Changes

We may update these terms from time to time. Material changes are notified in-app or by email at least 30 days before they take effect. Continued use after the effective date is acceptance.

10. Governing law

These terms are governed by Irish law. The courts of Ireland have exclusive jurisdiction over any dispute.
